AI-Features Terms
BRELLA AI FEATURES TERMS
Version. 1.1 Aug 13 2026
These terms govern the Organizer's use of optional AI features in the Service. They supplement the Brella Service – Organizer Terms and the Sales Agreement between the Parties (together, the "Agreement"); capitalised terms have the meanings given there.
The Organizer accepts these terms by activating an optional AI feature. They supplement the Agreement and do not replace it. Where these terms conflict with the Agreement in respect of an activated AI feature, these terms prevail as provided in the order of precedence in the Organizer Terms. In all other respects the Agreement applies in full, and nothing in these terms reduces the Company's obligations under it.
1. Activation and authority. Optional AI features are off by default and are identified as such in the Service. Only an administrator on the Organizer's Account may activate them, and activation requires affirmative acceptance of these terms in the Service. The individual accepting represents that they are authorised to bind the Organizer, and the Organizer, which is responsible under the Agreement for activity under its Account, agrees that such acceptance binds it.
2. Assistive only. AI output is probabilistic and may be inaccurate, incomplete, or biased. It is provided “as is”, without warranty of accuracy or fitness for a particular purpose, and does not constitute advice. The Organizer is responsible for the AI features it activates, for how it configures them, and for any decision it makes based on their output. The Organizer's use of AI output for any decision producing legal effects concerning an Attendee, or similarly significantly affecting an Attendee, within the meaning of Article 22 of the GDPR, is governed by, and subject to the conditions set out in the Organizer Terms.
3. Documented instruction. By activating an optional AI feature, the Organizer instructs the Company, for the purposes of Article 28(3) of the GDPR, to process Personal Data through that feature for the period it remains activated, for the purpose of generating summaries, recommendations, explanations, and other content by artificial-intelligence and machine-learning processing, including transmission to and processing by AI providers engaged as sub-processors. The categories of data subjects and Personal Data are those set out in the data protection provisions of the Agreement, excluding special categories. Those provisions otherwise apply in full: the Organizer is controller and the Company is processor.
4. Attendee notice and AI providers. The Organizer is responsible for the lawful basis for processing through AI features and for telling Attendees that AI is used, including in its privacy notice. Activation requires the Company to engage the AI providers listed in Annex 1 as sub-processors. By accepting these terms the Organizer specifically authorises that engagement under Article 28(2) of the GDPR. The Company has a written agreement with each imposing data protection obligations no less protective than the Company's own. Transfers outside the EEA are made by Brella as an exporter under the transfer mechanism in the data protection provisions of the Agreement.
5. Data use and model training. The Company does not use Organizer Data, Attendee Personal Data, private message content, or AI output to train, fine-tune, or otherwise develop or improve any artificial-intelligence or machine-learning model, including any general-purpose or foundation model, and does not make such data available to any third party for that purpose.
The Company processes Personal Data through AI features solely to provide the activated feature to the Organizer. For the improvement, development and evaluation of the Service, the Company uses only Anonymized Usage Data as defined in the Agreement.
6. Restrictions. The Organizer shall not: (a) submit special categories of Personal Data under Article 9 of the GDPR; (b) use AI features to infer an individual's emotions or protected characteristics; (c) use them for any purpose prohibited under Article 5 of Regulation (EU) 2024/1689, or to generate unlawful, discriminatory, deceptive, or infringing content; (d) use them to develop or train a competing product or model; or (e) reverse engineer the underlying models or circumvent any safety control.
7. Changes, deactivation, and general. The Company may amend these terms and change the available AI features. Where a change materially and adversely affects the Organizer's rights, the Company will give thirty (30) days' notice and the Organizer may decline it and continue under the accepted version until the end of the then-current Subscription Term. The Organizer may deactivate any AI feature at any time, and the Company may suspend one where continued provision would breach Applicable Law, Section 6, or its agreement with an AI provider. Sections 2 to 6 survive deactivation and termination. Liability, indemnification, warranties, governing law, and disputes are governed by the Agreement. If the Parties sign a separate agreement addressing AI features, it supersedes these terms to the extent of any conflict; in all other respects these terms continue to apply.
